Terms and Conditions

1.Sales
(a) Returns: Once an invoice (purchase) has been scheduled for delivery, the invoice items have been transferred to the Tim’s Furniture Mart (Tim’s) warehouse, or the customer has taken possession of the invoice items, all approved returns will be charged a 30% restocking fee. The restocking fee will be charged for all returns, including returns due to the customer's change in preference of color, size, fitting of item(s), or any other reason. There will be no refund of the delivery fee. After deducting the restocking fee and delivery fee, the customer shall be entitled to a refund or store credit for the remaining balance of the invoice amount.
(b) Cancellation: The customer may cancel an invoice within 48 hours of placement and receive a full refund of the invoice amount or store credit. All cancellations after the 48 hour period are subject to a cancellation charge in the amount of ten percent (10%) of the invoice amount. This provision does not apply to invoice items picked up by the customer or items delivered prior to the 48 hour period. If the customer has picked up the invoice items or a delivery date/time has been scheduled, the invoice will be treated as a return, and provisions of Section 1.a will apply. 
(c) Floor Samples/Clearance: All floor samples and clearance items are AS-IS and final sales. These items must be paid in full and picked up or scheduled for delivery within 72 hours of purchase. Tim’s and its agents are not responsible for damages to floor samples and clearance items after the sale of such items, and take no responsibility of any damage caused during delivery. 
(d) Special Orders: All special orders, factory-ordered merchandise and custom orders are final and are not subject to cancellation exchange or refund, unless otherwise provided herein.
(e) Personal Checks: Payments made by personal check may require a waiting time of 10 business days before the customer can take possession of the merchandise.
2.Price-Holds
This is for in-store purchases only. All price-holds are guarantees for the prices of the merchandise. A price-hold is not a layaway agreement and does not guarantee that Tim’s will hold a particular item chosen by the customer. Upon payment of a mandatory minimum deposit of 25% of the purchase price, including sales tax and delivery charges, Tim’s will hold the price on such items for a period of 50 days or until the customer pays for the items in full, whichever is sooner. The Customer shall have the right to cancel a price-hold agreement within seven days of the agreement and receive a full refund on the deposit. 
3.Unauthorized Terms and Errors
Any other terms and agreement not contained herein, whether oral or written are invalid unless expressly approved by management in writing and signed by the Tim’s manager. Miscalculations and system errors in sales terms and prices are subject to review by management and may be adjusted accordingly within 90 days of discovering the error.
4.Delivery
(a) Any merchandise left unscheduled for more than 2 weeks after becoming available for delivery shall be reallocated to common stock and treated as a cancellation hereunder. Tim’s is not responsible for delivery if incorrect contact information is submitted during the sale process. 
(b) Tim’s shall not be held responsible for failure to deliver if failure is caused by inclement weather, traffic issues or any other circumstances beyond the control of Tim’s. The delivery shall be rescheduled promptly. 
(c) Customers must be available to receive a scheduled delivery. A customer who cancels a scheduled delivery within 72 hours of the scheduled delivery or is unavailable to receive the delivery may be charged a re-delivery fee, in an amount equal to the original delivery fee. 
(d) In the event a customer refuses delivery due to the customer's change in preference, color, size, or fitting of purchased items, or for any other reasons, the provisions of Section 1.a shall apply. 
(e) By signing the delivery receipt, the customer releases Tim’s and its agents from any liability as a result of damage to the purchased items, the customer's home and/or property.
(f) Tim’s will not deliver merchandise above the third floor without an elevator. 
5.Pickup
(a) Customer must inspect all merchandise at time of pickup. Signature upon pickup represents merchandise being received in good condition and by signing, the customer releases Tim’s and its agents from any claim or damage to the purchased items or the customer's vehicle. 
(b) Tim’s and its agents are not responsible for loading purchased items onto the customer's vehicle. Tim’s shall not be responsible for damage to the customer's vehicle or for damage to the purchased items after pickup. 
(c) Tim’s is not responsible for any customer injuries during the process of handling/lifting purchased items and is also not responsible for the missing or damage of personal items during pickup. Customers are solely responsible for securing their vehicle during pickup. The customer whose name is on the invoice must be present for pickup or a waiver must be filled out. Customers must have a photo ID to pick up. 
6.Chargebacks and Returned Checks
There shall be a charge of $100.00 for any chargeback on a purchase applied to the credit card. Any returned checks will be subject to a charge of $35.00.
7.Merchandise Variation
Due to the nature of wood and marble, there may be slight variations in stain or grain of purchased items.  Variations in the veining of wood and marble are normal and expected. Any returns because of the variations due to the nature of wood and marble will be treated as a return based on customer preference and the provisions of Section 1.a shall apply.
8.Refunds
If a refund is permitted, cash and check payments will be refunded by Tim’s within 21 business days. Credit card payments will be credited directly to that credit card only. Financed purchases will be credited to that account. The customer shall also have the option of store credit.
9.Warranties
Tim’s supports manufacturers' warranties, when approved by the manufacturer. Additionally, third-party warranty coverage is available for purchase.
